Die Teilkündigung gemäß § 648a Abs. 2 BGB im Lichte neuerer Rechtsdogmatik

As part of the 2018 reform of construction contract law, the option of partial termination was implemented by law in Section 648a (2) BGB in addition to termination for good cause of the entire contract. This work examines the opportunities and risks in the application of partial termination. In addition to the dogmatic classification of the legal institution, it analyzes the requirements and legal consequences of the provision of section 648a (2) BGB and its problem areas. Following on from this, the transferability of this possibility to other termination rights such as the free partial termination pursuant to Section 648 BGB is examined. In addition, the consequences of an ineffective partial termination pursuant to Section 648a (2) BGB are discussed in order to counter these risks when drafting contracts.
