Die Überprüfung drittstaatlicher Unternehmensakquisitionen zum Schutz der öffentlichen Ordnung und Sicherheit in der Europäischen Union

The security-related screening of foreign corporate acquisitions by governments has been experiencing a new dynamic for some years now. Especially the remarkable increase in regulatory activities in Europe raises the question of whether deeper cooperation and harmonisation of laws in the EU should be pursued. The author examines this question from a variety of perspectives: Through considerations of legal policy, legal economics, competence, fundamental freedoms of the EU and international economic law, as well as a comparative analysis of the screening mechanisms of 14 Member States, the author creates a basis for future decisions as well as a specific proposal for a EU-wide minimum standard for security-related investment screening systems.
