With her study, the author examines the preclusions of objections under Sec. 238 (2) of the German Code of Criminal Procedure and the so-called “Widerspruchslösung” developed by case law from both a legal and legal policy perspective. In particular, the efforts to expand and combine these preclusions are critically reviewed. The author discusses the legal situation de lege ferenda and proposes a reform considering the narrowly defined need for a preclusion.
