This thesis is the first comprehensive analysis of the introduction of infringement-independent remedies in Section 32f ARC. It classifies the provision in terms of competition theory as a “direct enforcement of the competition principle”. In addition, it evaluates its implementation also with regard to the model regulation of the Market Investigation Regime in the UK, examines the compatibility of the provision with higher-ranking law and provides guidance on specific questions of application of divestiture pursuant to Section 32f (4) ARC.
