Sampling is one of the most important types of production in music today. Hardly any tracks in pop, electronic or black music can get by without using samples, in which single notes, sounds or melodies from live performances or from sound recordings are copied and used in the production of new music. This is the reason why every music maker faced with sampling will have asked themselves when it is possible for sampling to be free from permission and sanctions. This book attempts to answer this question by illustrating the various constelltions in which the compilation and copying of samples is possible without the consent of the rights holders and at what point, taking the progressive harmonisation of copyright law into consideration, the copyright of the composers of music and lyrics as well as the ancillary copyright of performing artists and producers of sound recordings is infringed.
