Even ten years after the outbreak of the financial crisis in 2008, its legal reappraisal is still not complete. Part of the risk management addressing legislative steps in banks by means of the national requirements based on CRD IV (sec. 25a KWG, InstitutsVergV n.F.) is the regulation of compensation.
On the one hand, the book investigates whether the regulatory intensity, which is based on the risk management function of variable compensation, is justified. On the other hand, it focuses on the application and practical implementation of the requirements in compensation agreements. The supervisory legislation pursues objectives which conflict with legal protection mechanisms of employment law, which raises questions that are relevant for practice. The author provides practical proposals for contract drafting. Furthermore, the author addresses the legislator in providing suggestions for legislative advancement.
