Description
The conversion of electricity generation from fossil fuels to the use of renewable energy sources is currently one of the central challenges in the EU, especially from a legal point of view. The author presents in German the legal situation of the promotion of renewable energies in Poland and analyzes its compatibility with European state aid law (Art. 107 TFEU). In doing so, the author provides a sound insight into European case law and comments on the dispute in the literature about the extension of the concept of state aid to purely private-law legal relationships, which is particularly important for levy-based funding instruments.
