Die Vererblichkeit von Accountnutzungsvereinbarungen und -inhalten

The work examines which account types and account contents are inheritable. To this end, the author first describes which criteria are relevant for the examination and works out that the criterion of value for universal succession is predominantly not taken into account correctly in the literature on the digital estate. The examination of the inheritability of the respective user agreements for the different accounts therefore also comes to different results. On the basis of the results found, it also critically examines the decision of the Federal Supreme Court on the digital estate, especially with regard to constitutional law and the rights of third parties.
