The thesis provides a comprehensive overview of the commencement of civil proceedings in three national legal systems as well as at the European level. First, the national classifications of the civil action, the content of the statement of claim, and the external formalities for commencing proceedings are examined. The thesis then focuses on a comparative analysis of the time at which the subject matter of the dispute is determined, followed by an analysis of the amendment of claims. The final part of the thesis examines texts aiming at cross-border coordination or harmonization, such as the ELI-UNIDROIT Model European Rules concerning the regulation of the statement of claim, the commencement of proceedings, and the amendment of claims.
