In Germany, a considerable amount of surface water bodies, especially of former mining lakes, is owned by private persons. Following the decision of the German Federal Administrative Court of March 23, 2018
[ECLI:DE:BVerwG:2018:240518U3C18.16.0], the study reveals that the right to property of private owners of surface water bodies is much stronger than assumed in the past. Concerning water law, the study deals with the usage of surface water bodies by proprietors, by the public and the navigability of surface water bodies owned by private persons, especially taking into account the water law of Saxony and Saxony-Anhalt.
