Description
Employed authors can not only claim for wage and minimum wage. In principle they can also claim for remuneration in accordance with sections 32 and 32a German Act on Copyright and Related Rights. Regarding to these remuneration claims employed authors are not specifically protected by the conflict of laws. With the example of the camerawoman and a worldwide cinema exploitation the work describes why it is necessary to enhance Article 8 of the Rome I Regulation accordingly. Thereby, it also describes why employed authors can not always claim for remuneration in accordance with sections 32 and 32a German Act on Copyright and Related Rights in case of international exploitation of their works due to the application of the preferable lex loci protectionis and in which of these cases an adjustment (“Anpassung”) is needed.
