The dissertation is intended for researchers, public authorities working in the field of capital markets law, and professionals in the compliance departments of investment firms. A distinctive feature of the work is its use of practical examples to present the abstract regulatory framework in a clear and accessible manner. It provides a detailed comparison between BaFin’s interpretative guidance and the implementation practices of investment firms, while also developing concrete proposals for improvement. The author hopes to contribute to the further development of the legislative framework and to draw the attention of the German financial supervisory authorities to inconsistencies in their interpretation of the law.
