Die Verwaltung des kollektiven Gesamtbetrags im eröffneten Insolvenzverfahren nach § 38 VDuG

This thesis provides the first comprehensive analysis of the intersection between distribution proceedings under the VDuG and insolvency proceedings, and offers solutions to the distribution conflicts that arise from this overlap. The starting point is § 38 VDuG, which governs the convergence of these two proceedings. The study highlights the doctrinal weaknesses of the provision, analyzes its practical implications for court-appointed financial administrators and creditors, and develops approaches for the consistent coordination of both distribution procedures. In doing so, the thesis fills a research gap and provides guidance for both academia and practice.
