The paper close a gap in the academic analysis of section 26a German Code of Criminal Procedure by examine its compatibility with the right to lawful judge. Despite the criteria, established by the German Federal Constitutional Court, the application of section 26a German Code of Criminal Procedure is still associated with a high degree of uncertainty. This is primarily attributable to blurred and abstract requirements. The treatise has set itself the aim of concretise the criteria of the German Federal Constitutional Court and make them manageable for practice.
