The extent of the consequences of CJEU judgments often also depends on the periods covered by the effects of these judgments. The consequences tend to be particularly far-reaching if CJEU judgments also apply – as they usually do – to past periods. Although the Court may limit the temporal scope of its judgments, it has so far been very reluctant to make use of this instrument. In this context, the book analyses the requirements established by the CJEU for a limitation of the temporal effects of its judgments and explores the Court’s exact shaping of the effects. Covering also relevant jurisprudence of the German Federal Constitutional Court, the Austrian Constitutional Court as well as the French Conseil Constitutionnel and the Conseil d’État, the book reveals the different problematic parts of the jurisprudence of the CJEU and makes proposals for a further development of this jurisprudence.
