Die Zäsurwirkung von Urteilen bei der nachträglichen Gesamtstrafenbildung

According to the prevailing opinion, if a sentence is handed down for crimes committed both before and after a previous conviction, the first conviction constitutes a caesura, meaning that two separate sentences must be handed down. The same applies when sentences are handed down for offenses committed between two previous convictions, the offenses of which were combined into a single sentence in accordance with § 55 StGB. These two constellations and their variations (e.g. when the sentence from the previous conviction is discharged) are presented in a practical manner in the work using sketches and the ratio of the total sentence is critically examined with regard to the caesura effect.
