In 2022, the new European Sustainability Regulation introduced a regulatory requirement for the financial services industry to request sustainability preferences when providing investment advice, but the liability consequences of non-compliance are unclear. The author therefore examines the civil liability of investment advisors for investment recommendations that do not reflect clients' sustainability preferences. She first presents the main objectives of the EU sustainability regulation, the legal framework and the complex EU requirements for the duty to provide information that are of interest here. Finally, she examines the implications for national law, with a focus on civil liability law in the area of investment advice.
