The Encrochat proceedings brought unresolved issues surrounding the gathering and admissibility of cross-border evidence to the fore. The questions underlying these proceedings are the focus of this book. Alba Hernández Weiss examines the problems of transferring and admitting cross-border evidence against the backdrop of the principles and dynamics of the Area of Freedom, Security and Justice. Using Encrochat as a case study, she analyses case law from German, Dutch, Spanish and European courts to examine current problems, existing approaches and benchmarks for further EU legislation in this area.
