Die Zurechnung bei Straftaten aus Gruppen

§ 184j StGB is one of the most criticized provisions of the German Criminal Code. The criticism refers in particular to the lack of compatibility with the principle of personal liability. The authour succeeds – with recourse to social psychology – in refuting the criticism. The attribution made by § 184j StGB proves to be reasonable against the background of group dynamics. On the basis of this finding, the authour addresses the question of the need for a general norm for all criminal acts committed from within a group. He concludes that there is a need for regulation only for sexual offenses. Finally, the author presents an alternative wording for § 184j StGB.
