Die gesetzliche Regelung der Triage

Within the context of constitutional law, criminal law and ethics, this book examines the dilemma of triage: who is allowed to survive when medical resources are limited? In addition to the legal and ethical foundations of triage, the work concentrates on the legal framework governing allocation decisions. The focus is on the provisions of Section 5c of the Infection Protection Act, which was enacted in 2022 and declared unconstitutional in 2025, with particular critical analysis of the allocation criterion of ‘probability of survival’ and possible alternative allocation criteria. Finally, the criminal liability risks for medical staff in the context of triage decisions are analysed.
