Ascertaining the proper purpose of special payments poses significant challenges for labour courts. This study develops criteria for its systematic determination and uses the example of the Christmas bonus to illustrate how complex eligibility requirements should be legally classified. To this end, it first identifies the various purposes served by the Christmas bonus and examines the theoretical foundations underlying their attribution. Building on this, the relevant criteria are analysed and evaluated. The thesis thus contributes to clarifying existing points of uncertainty and establishes a systematic foundation for the legal assessment of special payments.
