Description
Digitalization offers opportunities to improve access to civil justice. At the same time, it challenges the principle-based civil procedure. Twenty-first-century technology is encountering a procedural law whose fundamental concepts and regulations date back to the nineteenth century. Procedural principles, on the one hand, provide the framework for reforms and, on the other hand, must themselves be re-examined in light of digitalization. This thesis examines two examples from the current German reform discourse: the justice portal and virtual hearings. Using these examples, the author demonstrates how the digitization of civil justice can be structured in accordance with procedural principles.
