Description
The thesis deals with the supranational protection of rights in rem in assets which are situated within the territory of another Member State at the time of the opening of cross-border proceedings, particular of impairments of the right in rem in the context of the German insolvency plan. The norm of Art. 8 (1) EIR is intended to resolve the tension of rights in rem between a universal procedure and the 26 different property and insolvency laws of the Member States. This is significant, since the integrity of the property law system is of extraordinary importance for credit protection law. Nevertheless, this arrangement must not be at the expense of the effectiveness and economic efficiency of the procedure.
