The book puts the existing legal protection options in the event of practices contrary to collective bargaining agreements to the test. In addition to more recent dogmatic challenges – for example through the Collective Bargaining Unity Act or the case law on declarations of compliance with collective agreements and specific declarations of general applicability – the work contains an in-depth and differentiated analysis of the constitutional and collective bargaining law foundations. The insights gained are of significance for collective bargaining law as a whole. In addition to new lines of argumentation, the book also provides a structured categorisation of the complex range of opinions for all relevant legal protection options and thus enables quick access to the problem.
