Intellectual Property Rights are currently facing massive challenges, for example determining the scope and limits of property rights, and setting standards for the accumulation of the aforesaid property rights. Furthermore, the current system of regulations is under severe pressure to legitimize itself: Legal standards have become increasingly outdated, different interests can no longer be balanced and comparable legal issues are dealt with in different ways. The book addresses these aspects by tackling the question of whether specific property rights can be reduced to abstract unitary principals. Firstly the author provides a definition for an “Allgemeiner Teil” (general part) and suggestions are developed based on a comprehensive overview of the existing body of national legal standards and international codifications.
