The departure from the principle of enumeration creates a new system within the law of strict liability. It represents a reform that has been contemplated in German law but has not been implemented. The turning point in Turkish law is the introduction of a general rule on strict liability, modelled on its Swiss counterpart. What was once a theoretical approach has thus been given a statutory foundation.
The work presents an alternative to the principle of enumeration prevailing in German law. It serves to enhance understanding of the feasibility and design of a general clause for strict liability and enables both positive and negative conclusions to be drawn for one’s own reform considerations.
