In competing for custom, one of the most important factors is the safety of one"s investments. This is why insurance houses whose effectiveness is uneven can distort competition. In the single market, the EC directive on investment insurance is intended to guarantee, in terms of competition, a level playing field for all credit institutes. Our author"s work carefully scrutinizes the Directive"s utility and legality, while setting forth and comparing various alternative models for giving shape to investment insurance. In so doing it relies on German, Japanese and US experience allied to established economic theory. The writer demonstrates, more particularly, that the tug of war between investment insurance and guaranteeing straight competition can be successfully surmounted. On the subject of its legality, he comes to the same conclusion as the European judges in C-233/94 who, in May 1997, threw out an appeal against the Directive brought by Federal Germany.
