Description
The call for more rapid interventions by the antitrust authorities in cases of imminent harm to competition is almost as old as the antitrust authorities themselves. Especially in view of the increasingly digitalised economy, such action appears to be even more urgent. The German legislator reacted in 2021 with the revision of § 32a GWB and facilitated the imposition of interim measures by the cartel authorities. The European Commission also intends to use the instrument, which was first used in 2019 against the chip manufacturer Broadcom since its adoption in Article 8 of Regulation 1/2003, more frequently. This study explores why the instrument has so far been used so rarely and what possibilities exist to revive it.
