The federal legislature revised disciplinary law in 2023. At the heart of the amendment is the abolition of the requirement for a judge’s approval for dismissal from civil service in favor of an administrative authority’s power to dismiss, along with a shift to a repressive mode of legal protection. Although the Federal Constitutional Court has approved this paradigm shift, ongoing criticism in the legal literature provides grounds for critically examining it. This thesis addresses this by analyzing the current state of disciplinary law, identifying existing tensions, and comparing it with the traditional principles of the professional civil service, with particular attention to the concept of constitutionally mandated judicial review.
