The first Chinese Social Security Law of 2011 states that the state should set up a social security system that is based on the legal guideline of sustainability. In this study, the author discusses a question which is still unresolved in China: What is the role of this principle of ‘sustainability’, which is hardly substantiated by legislators, as a legal concept in the pension scheme system?
