Europarecht als Weichenstellung zur institutionellen Unabhängigkeit deutscher Justiz?

Does European Union law impose requirements on the administration of German courts? And if so, which ones? The author answers these questions with particular attention to the appointment of judges. So far, the debate on the administration of the judiciary has focused on constitutional law, comparative law and legal policy aspects. The author now seeks to include the perspective of European Union law. To this end, he analyses the European Union’s legal framework on the independence of the judiciary in light of recent case law of the European Court of Justice and the European Court of Human Rights.
