Details
The book deals with the relationship between European law and the organisation of civil justice in the Member States: From different perspectives, the authors examine the extent to which primary and secondary EU law and the case law of the ECJ and the ECHR influence not only national civil procedural law, but increasingly also national court systems. The focus is on the European framework conditions for the independence of the courts, but also on what European law understands by a court or a court decision, which decisions may only be entrusted to genuine courts and to what extent appeals must be made available.
