Description
In environmental law the limits of growth are transformed into norms. However, it is not always easy to distinguish between real natural restrictions and assumed "practical constraints".
The contributions to this volume use theoretical approaches or case-studies to clarify the relationship between expertise and environmental law.
This book is subdivided into three parts on precautionary regulation, global rule-making, and the inclusion of societal aspects through market-based instruments and public participation. A central message is that while facts do not logically imply norms, environmental practice shows that fact- and value-questions are closely intertwined and cannot be answered separately. The interaction of scientific expertise, political planning and law has to be organized accordingly.
