Exemplary Damages nach englischem Recht

The English exemplary damages, which have a long history and are deeply interwoven with special features of common law, are multifunctional in today's application and dogmatic classification and cannot be limited to the pursuit of punitive or preventive purposes. In individual cases, they are comparable to the functions of German legal institutions. Today, they are granted very restrictively, only to a relatively small extent, to certain categories of cases and if special requirements are met.
This work is a functional, comparative law analysis of English exemplary damages. Areas of research are comparative law, English law, private international and civil procedure law and law of damages.
