Experimentierklauseln für die Energiewende

Experimentation clauses serve to "open up" the legal framework so that innovations can be tested in practice. This way, knowledge for the further development of the law is to be gained.
In the energy sector, such a clause was created with the SINTEG-Regulation. This dissertation seeks to draw lessons from the SINTEG-Regulation for future experimentation clauses. For this purpose, it is analysed what a "good" experimentation clause must look like. Subsequently, the SINTEG-Regulation is measured against this. This yields lessons for the design of future experimentation clauses. Finally, the study examines how these lessons could be implemented taking into account constitutional and EU law requirements.
