Finanzgläubiger in der Stabilisierung des Schuldners

How does the German restructuring moratorium under the StaRUG (so-called stabilization order) work when it comes to including financial creditors? What procedural rights does this group of creditors have, and how does the moratorium affect financial contracts? This study answers these still unresolved questions in a comprehensive legal analysis that includes elements of legal history, sociology of law and a comparative law approach. In addition, the weaknesses of the moratorium are evaluated as a whole and a corresponding reform proposal for the evaluation of the StaRUG is submitted.
