Twenty years after the adoption of the extended competence in the area of judicial cooperation under the Amsterdam Treaty, numerous instruments on European civil procedure have been developed by the EU legislature, and applied by national courts. These instruments have built a genuine Judicial Area where citizens and businesses can rely on operating justice systems and functioning cross-border cooperation.
The present book focusses on how to move beyond common rules and towards best practices. The theme is inspired by the shift in focus from the establishment of new legislation with common rules to a focus on the actual implementation, application, and operationalization of the rules on cooperation in civil justice.

»Der Tagungsband zündet mit seinen 23 Beiträgen ein Feuerwerk vielfältiger Perspektiven auf ein Thema, das die Diskussion um die Fortentwicklung des Europäischen Zivilverfahrensrechts maßgeblich bestimmen wird. Der Grundthese der beiden Herausgeber ist uneingeschränkt zuzustimmen. Dabei haben freilich die Beiträge eindrucksvoll gezeigt, dass der Weg von common rules hin zu best practices kein einfacher sein wird. Aber das war, wie Marcel Storme in seinem Schlussplädoyer gezeigt hat, im Gang der Entwicklung des Europäischen Zivilverfahrensrechts noch nie der Fall. Der Tagungsband zeigt jedoch auch, dass es ein Weg ist, der sich zu gehen lohnt. Und dass es ein spannender bleibt. Die Beiträge des Tagungsbandes werden dabei wertvolle Wegweiser sein.«
