Intellectual property in crime – is there such thing? Is it permissible for a criminal to commercialize the story of his crime? In order to resolve the resulting conflict with interests of privacy of the victim, the author develops a practice-oriented auditing concept for legal treatment. Next to a comprehensive evaluation of the German jurisdiction concerning the commercialization of cases with reference to reality, the author focuses on legal consequences and damage claims of crime victims faced with the commercialization of the criminal act they had experienced. The analysis concludes with a comparative view on U.S. American law.
The author worked as a research assistant at the Institute of Intellectual Property, Competition and Media Law at the Technische Universität Dresden and is now part of the direction of a German correctional facility.
