Description
The design of traffic areas is characterised by conflicts of interest and distribution. Which actor in the multi-level system can make which road law decisions is therefore of particular relevance. This paper addresses the question of whether road law, using the legal situation in North Rhine-Westphalia as an example, is a suitable instrument for municipalities to implement their transport policy. From an administrative and constitutional law perspective, it addresses both the dogmatic foundations of road law and current concepts for traffic space design. Particular attention is paid to the classification of parking within the scope of road traffic law and the consideration of municipal interests in discretionary decisions.
