This volume examines interaction in European court communities and their impact on national policy developments and fundamental rights in Europe. The Court of Justice of the EU and the European Court of Human Rights enjoy high regard, but only their interaction with national courts and other stakeholders can explain their power.
The questions of how courts interact between cooperation and competition and under which conditions the law can shape policies are investigated theoretically and empirically in this book. Based on the structures, formats and forms of interaction, patterns are identified in data protection, employment legislation, patent law, religious freedom, privacy, security, asylum, defence, and economic and corporate governance. All the book’s authors have worked extensively on the relationship between law and politics.
