Investigative journalism may come into conflict with trade secrets. In such cases, the question arises as to which legal rules and principles should be followed to resolve the conflict between the protection of trade secrets and investigative media activities. The German Trade Secrets Act (GeschGehG), which transposes the EU Trade Secrets Directive, has introduced new rules on the protection of trade secrets in Germany. The publication focusses on the legal implications that the GeschGehG has for media. In addition, it addresses several issues that become relevant in connection with investigative research and reporting targeting businesses.
