The thesis deals with the distinction between trade secrets and the work experience of former employees. The author distinguishes the terms and finds practical criteria for the remaining consideration.

The distinction between trade secrets and the experience of former employees has always been the "cardinal problem" of trade secret law. With the entry into force of the GeschGehG in 2019, the law in Germany has been revised. Against this background, the author reassesses the distinction between trade secrets and employee experience. In particular, he draws on comparative US law and interdisciplinary findings from the field of knowledge management.
