Gesellschaftsrechtliche Herausforderungen an die Höfeordnung durch den Agrarstrukturwandel

Against existing prejudices and resistance, farming in the form of corporate farms is also gaining ground in the area covered by the Northwest German Höfeordnung. However, this can have considerable (negative) effects on the inheritance of farms according to the regulations of the Höfeordnung. The study highlights these effects and addresses the question of whether an adjustment of the status quo is necessary against the background of the increasing importance of company law in agriculture. Building on this, the work concludes with a reform proposal for reforming the provisions found to be disadvantageous.
