Gesellschaftsrechtliche Streitigkeiten in institutionellen Schiedsverfahren

With its landmark decision „Schiedsfähigkeit II“ the German Federal Court of Justice decided that disputes regarding the validity of a shareholder resolution in a limited liability company may be arbitrated if certain requirements are fulfilled. This book contains a comprehensive analysis of the issues arising out of this decision. A complex study of all varieties of corporate disputes shows that the requirements stipulated by the Federal Court of Justice must also apply to other types of disputes. The analysis of the implementation focuses on the Supplementary Rules for Corporate Law Disputes developed by the German Arbitration Institute and points out their strengths and weaknesses compared to other institutional arbitration rules.
