This dissertation is the first monographic illustration to address the topic of the legal minimum wage. The discussion focusses on the core problems concerning civil and industrial law, which concern the subject of the legal minimum wage (effective since January 1st 2015). Who can claim the legal minimum wage? How is it being calculated? How to proceed with non hourly based time pay and performance linked payment? Are standby duty and on-call duty to be reimbursed with the minimum wage? Which bonus and extra payments are included? Can an embedment of one-off payments be considered?
Furthermore a detailed legal comparison with the French legal minimum wage, the salaire interprofessionnel de croissance (SMIC), is given. Finally the topic of client liability, which has a high practical relevance, is being examined.
