Grenzüberschreitende Arbeitnehmerüberlassung aus Polen nach Deutschland

The work focuses on the cross-border supply of temporary workers between Poland and Germany. The author uses as a basis for his analysis the example of a polish temporary worker hired by a polish temporary work agency to work in Germany.
He begins with the determination of the applicable provisions of labour law from a Conflicts of Laws perspective. After settling on the relevant legislation, he presents different models of employment. A deeper examination of the principles of equal treatment follows as does the examination of possibilities to deviate from them. Apart from the thorough illustration of the Contract Law, the author also describes the possible implications of Trade, Residence, Tax, Social Security and Criminal Law. He also explains the legal consequences of illegal temporary work and the influence of the assignment certificate on the legal relations.
