Description
The digitalization of civil procedure is ubiquitous. Every one of its areas is increasingly shaped by digital elements. This opens up new possibilities but also raises some concerns. Cross-border examination of witnesses is one example of this. Traditionally, the direct examination of witnesses by a foreign court is rejected due to possible violations of sovereignty. However, the possibility of digital participation calls this approach into question. This work examines the existing approaches from the perspective of German international civil procedure law. In doing so, it draws on German criminal procedure law and makes occasional reference to US international civil procedure law.
