Grund- und menschenrechtlicher Schutz vor Antisemitismus

This study develops a new approach to protection against antisemitism grounded in fundamental and human rights, placing the rights of those affected at the center. Based on the case law of the Federal Constitutional Court and the European Court of Human Rights, it examines how antisemitism is legally defined, which forms of antisemitism are taken into account, and where gaps in protection exist. The thesis analyzes the protective potential of the guarantee of human dignity, the special principle of equality, the general right of personality, and the European Convention on Human Rights, and examines in particular whether antisemitic discrimination should be recognized as a distinct category under the general right of personality.
