Public law preemptive rights are of high importance in the discussion about a fair building law. At the same time, however, they cause negative effects on real estate transactions. This work addresses the particular systematics of the exercise of public law preemptive rights and the consequences resulting from the interaction of public law regulations with the preemptive right-related provisions of civil law. A further focal point is the constitutional compatibility of the exercise of public law preemptive rights. Moreover, this work presents the problems arising from the exercise of preemptive rights and provides practical solutions.
