The thesis sheds light on the question of liability when a defect in the work of art becomes apparent. The topic of the thesis is a special field in the purchasing law of the German Civil Code (BGB), and part of art law's own academic discourse.
The author addresses several practice-relevant questions in relation to the art market but breaks new legal perspectives in the question of whether works of art can be subsumed under the concept of a "used" object.
